Terms of Agreement

Tu Valencia Relocation Agency
Effective Date: January 1st, 2025
These Terms of Agreement govern the provision of relocation services by Tu Valencia Relocation Agency  to the client.

By engaging our Services, you agree to these terms and conditions.

1. Scope of Services

1.1 The Agency provides relocation services including but not limited to:

  • Pre-assignment consultation and needs assessment

  • Immigration and visa assistance (through licensed partners, where applicable)

  • Temporary and permanent housing search

  • School search and educational advisory

  • Orientation tours and local area familiarization

  • Settling-in services (bank accounts, utilities, healthcare registration, etc.)

  • Cultural and language support

  • Departure and repatriation assistance

1.2 The exact scope of services will be defined in the Service Proposal or Work Order agreed upon by both parties.

 

2. Third-Party Providers

2.1 The Agency may engage third-party service providers (e.g., immigration lawyers, landlords, movers, schools, or utility companies) to deliver parts of the Services.
2.2 While the Agency coordinates and facilitates these services, the contractual relationship for such services may be directly between the Client and the third party.
2.3 The Agency shall not be held liable for the acts, omissions, or performance of third-party providers.

 

3. Fees and Payment

3.1 Fees for Services will be set out in the quotation or service agreement.
3.2 A retainer or deposit of 300 euros is required to confirm services.
3.3 Invoices are payable within 5 days of issue, unless otherwise agreed.
3.4 The Agency reserves the right to suspend or withhold services if payment is overdue.
3.5 Additional costs incurred on behalf of the Client (e.g., government fees, school application fees, deposits, travel expenses) are the responsibility of the Client and must be reimbursed, unless otherwise agreed.

 

4. Housing

4.1 In the case of housing search services, the full service fee is due upon the successful securing of a rental or purchase agreement, regardless of how many listings have been shared or property visits conducted. 

4.2 Early success in securing accommodation is considered a result of Tu Valencia’s professional expertise and constitutes full delivery of the contracted service.)

 

5. School Search

5.1 For school search services, the service fee is payable in full upon completion of the school application support process, regardless of whether or not the child is ultimately admitted. 

5.2 The outcome of school applications rests entirely with the institutions themselves.

 

6. Client Responsibilities

6.1 The Client must provide accurate and complete information required to perform the Services.
6.2 The Client is responsible for compliance with immigration, residency, and local laws.
6.3 The Client must attend scheduled appointments, viewings, and orientation sessions, or notify the Agency of cancellations in advance.
6.4 The Client is responsible for entering into contracts (e.g., lease agreements) and making payments directly to third parties unless otherwise agreed.

 

7. Confidentiality and Data Protection

7.1 The Agency will treat all Client information as confidential and will only share information with third parties as necessary to perform the Services.
7.2 The Agency complies with applicable data protection and privacy laws.

 

8. Limitations of Liability

8.1 The Agency will use reasonable care and skill in providing the Services. As such, we cannot guarantee the approval, acceptance, or outcome of any application, request, or process involving these third parties. All final decisions, including, but not limited to, visa approvals, residence permits, school admissions, utility connections, or bank account openings, are made solely at the discretion of the respective authorities or organizations.

8.2 Our role is to assist, guide, and facilitate based on our experience and network of trusted professionals. Clients remain responsible for all final decisions and the provision of accurate, complete documentation.

8.3 By engaging our services, clients acknowledge and accept that Tu Valencia Relocation Agency is not liable for delays, denials, or changes resulting from the actions, requirements, or decisions of third parties.

8.4 The Agency is not liable for:

  • Decisions made by government authorities, schools, landlords, or third parties.

  • Delays caused by immigration processes, housing market conditions, or external factors beyond the Agency’s control.

  • Any indirect, incidental, or consequential losses.

8.5 The Agency’s total liability under this Agreement shall not exceed the amount of fees paid for the specific Service giving rise to the claim.

 

9. Cancellation and Termination

9.1 If the Client cancels Services after confirmation, cancellation fees may apply as specified in the quotation.
9.2 Either party may terminate this Agreement with written notice if the other party breaches its obligations and fails to remedy within [insert timeframe, e.g., 14 days].
9.3 Fees for Services already rendered or started are non-refundable.

 

10. Force Majeure

10.1 The Agency shall not be liable for delays or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or labor disputes.

 

11. Governing Law and Dispute Resolution

11.1 This Agreement shall be governed by the laws of Valencia, Spain.
11.2 Any disputes shall first be addressed through good-faith negotiation.
11.3 If unresolved, disputes shall be referred to mediation or arbitration before proceeding to court.

 

12. Entire Agreement

12.1 This Agreement constitutes the entire understanding between the parties and supersedes all prior communications, proposals, or agreements regarding the Services.
